8. Analysis tools

The tracking measures used as listed in the following are deployed in accordance with Art. 6.1.1 lit. f GDPR. The tracking measures are used in order to ensure the appropriate design and continuous optimisation of our website. The tracking measures are also used to statistically record the use of our website and to analyse our offer for optimisation purposes. These interests are justified in accordance with the aforementioned provision.

Information on the respective data processing purposes and data categories can be found in the corresponding tracking tools.

8.1. Google Analytics

This website uses Google Analytics, a Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”) web analysis service, to ensure the appropriate design and continuous optimisation of our websites. Pseudonymised user profiles are generated and cookies (see Item 4) used in this connection. The information generated by the cookies regarding your use of this website such as

  • browser type/version,
  • operating system used,
  • referrer URL (site visited beforehand),
  • hostname of requesting computer (IP address),
  • time of server request,

is transferred to a Google server in the USA and saved. The information is used to analyse the use of the website, to compile reports on website activities, and to provide further services connected to website use and internet use for the purposes of market research and the appropriate design of these websites. This information is also forwarded to third parties insofar as this is legally stipulated or insofar as third parties are contracted to process these data. Under no circumstances shall your IP address be linked to other data from Google. IP addresses are anonymised to rule out allocation (IP masking).

You can prevent the installation of cookies with the respective setting in the browser software; please note, however, that in this case it may not be possible to use all of the functions of this website to their full extent.

Furthermore, you can prevent the collection of the data generated by the cookie and data connected to your use of the website (incl. your IP address) and the processing of these data by Google by downloading and installing a browser add-on.

Alternatively to the browser add-on, in particular for browsers on mobile end devices, you can also prevent collection by Google Analytics by clicking on this link. An opt-out cookie is placed which prevents the future collection of your data when visiting this website. The opt-out cookie is only valid in that browser and only for our website and is deposited on your device. If you delete the cookies in that browser, the opt-out cookie has to be placed again.

Further information regarding data protection in conjunction with Google Analytics can be found on the Google Analytics help page.

8.2. Google Adwords Conversion Tracking

We also use Google Conversion Tracking to statistically record the use of our website and optimise our website for you. Google Adwords places a cookie (see Item 4) on your computer insofar as you accessed our website via a Google advertisement.

These cookies expire after 30 days and are not used for personal identification. If users visit certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can detect that the user clicked on an advertisement and was forwarded to that site.

Each Adwords customer is allocated a different cookie. Cookies can thus not be tracked via Adwords customers’ websites. The information obtained using the conversion cookie serves to generate conversion statistics for Adwords customers who have elected to use conversion tracking. The Adwords customers find out the total number of users who clicked on their advertisement and were forwarded to a site equipped with a conversion tracking tag. They do not, however, receive any information which personally identifies the user.

If you do not wish to participate in a tracking process, you may also object to the use of the placement of cookies required – for example by adjusting your browser setting to generally deactivate the automatic placement of cookies. You can also deactivate conversion tracking cookies by configuring your browser to block cookies from the “www.googleadservices.com” domain. Google’s data privacy policy on conversion tracking can be found here.

8.3. Matomo

We use the open source software Matomo to analyse and statistically evaluate the use of our website. Cookies are used to do so (see Item 4). The information generated by the cookie about website use is transferred to our server and collated in pseudonymised user profiles. The information is used to evaluate the use of the website and to enable the appropriate design of our website. The data shall not be forwarded to third parties.

The IP address shall by no means be connected to other data corresponding to the user. IP addresses are anonymised to rule out allocation (IP masking).

Your visit to this website is currently recorded by Matomo web analytics. Click here to object to your visit being analysed.

9. Social Media Plugins

In accordance with Art. 6.1.1 lit. f GDPR, we use social media plugins from the social networks Facebook, Twitter and Instagram to increase our publicity. The underlying marketing purpose is to be deemed a justified interest in accordance with the GDPR. The respective providers are responsible for ensuring that they are operated in conformity with data protection regulations. We integrate these plugins using the ‘two-click method’ to offer the best possible protection to our website users.

9.1. Facebook

Facebook social media plugins are used on our website to make its use more personal. The “LIKE” and “SHARE” buttons are used in this connection. This is a service provided by Facebook.

If you access one of our webpages which contains such a plugin, your browser generates a direct connection to the Facebook servers. The content of the plugin is transferred directly by Facebook to your browser, where it is then integrated into the website.

By integrating the plugin, Facebook gains the information that your browser has accessed our respective webpage, even if you do not have a Facebook account or are not currently logged in on Facebook. This information (including your IP address) is transferred directly to a Facebook server in the USA where it is saved.

If you are logged in on Facebook, Facebook can directly allocate the visit to our website to your Facebook account. If you interact with the plugins, for example by clicking the “LIKE” or “SHARE” buttons, the corresponding information is also transferred directly to a Facebook server where it is saved. Furthermore, the information is published on Facebook and displayed to your Facebook friends.

Facebook can use this information for advertising, market research and the appropriate design of Facebook pages. To do so, Facebook creates use, interest and relationship profiles, e.g. to analyse your use of our website regarding the online advertisements shown to you on Facebook, to inform other Facebook users about your activities on our website, and to provide further services linked to the use of Facebook.

If you do not wish Facebook to link the data collected via our website with your Facebook account, you must log out of Facebook before visiting our website.
Please refer to the Facebook Privacy Policy for details about the purpose and scope of data collection and further processing and use of data by Facebook, and for your related rights and settings options to protect your privacy.

9 .2. Twitter

Plugins from the short messaging network Twitter Inc. (Twitter) are integrated into our websites. You can recognise the Twitter plugins (tweet button) on our site by the Twitter logo. An explanation of tweet buttons can be found here.

If you access one of our webpages which contains such a plugin, a direct connection is generated between your browser and the Twitter server. Twitter thereby receives the information that you have visited our site with your IP address. If you click the Twitter “tweet” button whilst logged in to your Twitter account, you can link the contents of our pages on your Twitter profile. That allows Twitter to connect the visit of our sites with your user account. We hereby inform you that as provider of the sites we have no knowledge of the content of the data transferred or its use by Twitter.

If you do not wish Twitter to connect the visit of our sites, please log out of your Twitter account.

Further information can be found in the Twitter data privacy policy.

9.3. Instagram

Our website also uses social plugins (plugins) from Instagram, operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”).
The plugins are marked with an Instagram logo, for example the “Instagram camera”.

If you access one of our webpages which contains such a plugin, your browser generates a direct connection to the Instagram servers. The content of the plugin is transferred directly by Instagram to your browser, where it is then integrated into the website. By integrating the plugin, Instagram gains the information that your browser has accessed our respective webpage, even if you do not have an Instagram profile or are not currently logged in on Instagram.

This information (including your IP address) is transferred directly to an Instagram server in the USA where it is saved. If you are logged in on Instagram, Instagram can directly allocate the visit to our website to your Instagram account. If you interact with the plugins, for example by clicking the “Instagram” buttons, this information is also transferred directly to an Instagram server where it is saved.

The information is also published and displayed to your contacts on your Instagram account.

If you do not wish Instagram to directly link the data collected via our website with your Instagram account, you must log out of Instagram before visiting our website.

Further information can be found in the Instagram data privacy policy.

10. Objection to data collection

Insofar as your personal data are collected on the basis of justified interests in accordance with Art. 6.1.1 lit. t GDPR, pursuant to Art. 21 GDPR you have the right to object to the processing of your personal data on grounds relating to your particular situation or to direct marketing. In the latter case, you have a general right to object which is implemented by us without stating a particular situation.

An email to info@haupt-fashion.com suffices to exercise your right to withdraw or your right to object.

11. Data security SSL encryption

For security reasons and to safeguard the transfer of confidential contents such as enquiries sent to us as site operators, this site uses an SSL encryption (Secure Socket Layer) in conjunction with the respective highest encryption level supported by your browser. This is generally a 256 bit encryption. In the event that your browser does not support 256 bit encryption, 128 bit v3 technology shall be used. An encrypted connection is indicated by the address line in your browser changing from “http://” to “https://” and by the padlock symbol.

When SSL encryption is activated, the data that you transfer to us cannot be intercepted by third parties.

Furthermore, we also employ suitable technical and organisational security measures to protect your data from unintentional or intentional manipulation, partial or complete loss, destruction, and unauthorised third-party access. Our security measures are continuously improved in line with the latest technological developments.

12. Data subject rights

In accordance with:

  • Art. 15 GDPR you have the right to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of the personal data, the categories of recipients to whom your data have been or will be disclosed, the envisaged storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data insofar as they were not collected by us, and about the existence of an automated decision-making process including profiling and where applicable meaningful information about the details thereof;
  • Art. 16 GDPR you have the right to obtain without undue delay the rectification of inaccurate or completion of personal data saved by us;
  • Art. 17 GDPR you have the right to request erasure of your personal data saved by us, insofar as processing is not required to exercise the right of freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;
  • Art. 18 GDPR you have the right to request the restriction of processing of your personal data insofar as you dispute the accuracy of the data, processing is unlawful but you object to erasure of the data and we no longer require the data but you require the data for the establishment, for the exercise or defence of legal claims, or you have objected to processing pursuant to Art. 21 GDPR;
  • Art. 20 GDPR you have the right to obtain the personal data you provided us with in a structured, commonly used and machine-readable format or request their transmission to another controller;
  • Art. 7.3 GDPR you have the right to withdraw your consent at any time. This means that we are no longer permitted to continue processing the data in the future for which consent was granted.
  • Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority. As a general rule, you can lodge the complaint with the supervisory authority of your common place of residence or work or of our company headquarters.

13. Objection to advertising mail

We hereby object to the use of contact data published in accordance with the imprint obligation to send unsolicited advertising and information materials. The site operators expressly reserve the right to take legal steps in the event of the unsolicited sending of advertising information, such as spam emails.

14. Validity and amendment of this data protection statement

This data protection statement is currently valid and was last updated in May 2018.

It may become necessary to amend this data protection statement as a result of the further development of our website and products, or due to amended legal or official requirements.
